Is Offering Compensation Mandatory?

No, offering compensation is entirely optional. Sellers have the freedom to decide what approach works best for their specific situation. Consulting with a knowledgeable agent can provide clarity on whether making an offer of compensation aligns with personal goals for the sale.

Does the Agent Need Permission?

Yes, any compensation offered to a buyer’s agent requires written approval from the seller. This ensures that the seller has control over the terms of the transaction and understands the implications of the compensation offered.

Types of Compensation

Sellers have various options when it comes to compensation:

  • One option is the seller can offer the listing agent. This is how it has traditionally been done. This is known as a Co-broker. The seller offers a total amount to the listing agent and that amount is split.
  • The second option is the seller can offer a set amount directly to the buyers agent. This can be stated as a percentage or a flat fee.
  • Seller will negotiate buyer's agent compensation, if any, with Buyer or Buyer's authorized representative through the purchase contract. So, as a seller, you simply say, “I am willing, but the amount will be negotiated with the contract, as with all other terms."

How Will Buyer’s Agents Know About Offers of Compensation?

Once an offer of compensation is approved, it can be communicated through various marketing channels, such as flyers, signs, social media posts, or direct communication. However, these offers cannot be listed on Multiple Listing Services (MLSs).

Should Compensation Offers Be Advertised?

Advertising an offer of compensation is not a requirement. While it can help attract more potential buyers, sellers can choose to negotiate this aspect privately within the purchase agreement.

Seller concessions differ from offers of compensation. Concessions involve the seller covering specific costs related to the home purchase, which can help reduce the buyer’s upfront expenses. This may include assistance with transaction costs or necessary property repairs.
